The Federal Trade Commission (FTC) has announced a final rule that bans almost all noncompete clauses nationwide. The new rule, which takes effect on September 4, 2024, will void existing noncompete clauses, except for those with senior executives that were in effect before September 5, 2024. Employers must provide written notice to affected workers if they are subject to noncompete clauses that are no longer enforceable. Additional information about the final rule, employee model notices, and FAQs can be found on the FTC’s Noncompete Rule page. If you have any questions or concerns about noncompete agreements or policies, it’s best to consult an attorney.

Effective July 1, 2024, the minimum salary required for the EAP (Executive, Administrative, Professional) exemptions from overtime will increase from $684 per week to $844 per week (equivalent to $43,888 per year). Also, the minimum total compensation requirement for the HCE exemption will increase to $132,964 per year, including at least $844 per week, which must be paid on a salary or fee basis.

Employers continue to be permitted to use nondiscretionary bonuses, incentive payments, and commissions to satisfy up to 10 percent of the minimum salary requirement ($84.40 per week in the second half of 2024) for the administrative, professional, and executive exemptions, as long as these forms of compensation are paid at least annually.

Currently, to fall within the executive, administrative, and professional (EAP) employee exemptions, an employee generally must:

Be paid a salary, meaning that they are paid a predetermined and fixed amount that is not subject to reduction because of variations in the quality or quantity of work performed (the “salary basis test”);

Be paid at least a specified weekly salary level; and

Primarily perform executive, administrative or professional duties, as provided in the DOL’s regulations (the “duties test”).

Highly compensated employees (HCEs) performing office or non-manual work and paid total annual compensation of a specified amount are exempt from the FLSA if they customarily and regularly perform at least one of the duties of an exempt executive, administrative or professional employee identified in the standard tests for exemption.

How does this impact you? Employers must review all employees paid on a salary basis to ensure they meet the salary requirements if they use the EAP salary exemption. If an employee does not meet the salary requirements, the employer can change the employee’s compensation to hourly or increase the salary to meet the salary requirements. Review the job duties tests referenced in the DOL Fact Sheet to determine whether or not an employee can be compensated hourly. (ADP, 6/14/2024)

Who is Idilus?

Idilus is a Professional Employer Organization or PEO. A PEO is a firm that any employer can use to outsource administrative management tasks. In our basic package, we offer the following:

Payroll Services We ensure that your employees will always be paid correctly and on time.

Benefits Management We provide your employees with health insurance, 401(k) options, and other benefits at competitive costs to your business. Imagine offering Fortune 500-level benefits to your employees for potentially less than you’re paying now.

Human Resources Management and Training At Idilus, we have a highly versatile staff that is trained and licensed in a variety of fields. We can partner with your existing staff to offer specialized training in any human resource area. We can also help you navigate tough situations like onboarding, firings, and bereavement practices.

Risk Management and Compliance You can focus on more important parts of your business while we focus on ever-changing labor laws so that your business is always compliant with the most recent standards.

The benefits of partnering with a PEO.

While many business owners have an I can do it all myself attitude, outsourcing your payroll services may save your business up to 100 hours a week on HR administration and compliance, depending on the number of employees you have. By having a dependable pay schedule, you can bolster company morale and loyalty while saving dollars on your bottom line.

Dependable pay is essential, but most employees search for companies that offer more than just a paycheck. Benefits, such as comprehensive health and 401(k) plans, are more critical than ever in today’s competitive job market. 78% of people say that health insurance is the most important benefit offered by their employer.
The problem, especially in small to mid-size businesses, is that offering large company benefits packages on a small budget is often difficult, if not completely out of the question. This can cause your company to miss out on more experienced and talented candidates because you cannot offer the benefits they want and need. The benefit of using a PEO like Idilus is tailored comprehensive benefits packages that are also affordable.

One of the most important parts of successful business ownership and execution is ensuring your employees feel heard daily. When you have many employees in various departments, this can be no small task. At Idilus, we offer two services to help with employee perception and satisfaction.

The first is training. Our highly qualified staff is equipped to train your staff in everything from appropriate workplace behavior to management team best practices. We can help tailor training programs to your company’s specific needs.

The second service we offer is full Human Resources coverage. This means that if someone has a death in the family, we can help you properly handle bereavement leave. Or, if you need to let an employee go, we can help you deal with the entire process. Don’t leave yourself and your business open to lawsuits and complaints in the HR department. Let us help you successfully train and take care of your employees so that you can focus on more important parts of the business.

As business owners, we know that keeping your employees safe is your top priority. Unfortunately, accidents happen on the job. Idilus offers comprehensive risk management and compliance services that can help mitigate costs in the event of employee injury. We also offer programs assessing your company’s HR practices to help prevent on-the-job accidents. By letting a PEO like Idilus handle your compliance and risk management, you can be sure that your company is always up to date on labor laws and standards, and your company is at a lesser risk for injury or lawsuit.

The biggest benefit of working with Idilus is that you can move forward and see greater growth for your company. When your employees feel well cared for, they will work harder for you. This translates to more revenue and the ability to add more talent to your team, allowing you to move your business into larger markets.

Is Idilus the right PEO for you?

At Idilus, we believe that employees are the most important part of any business. With over twenty years of experience in the employee services management field, we have built a team of highly qualified professionals trained and certified to handle all your business payroll, benefits management, and risk management needs. We hold a Better Business Bureau Accreditation, a National Association of Professional Employer Organizations (NAPEO) Membership, an Audited Financial Records Certification, and a New York County Medical Society Membership. In a world of ever-changing legal demands, standards, compliance laws, and employee expectations, we pride ourselves on setting industry standards for customer service. If you allow us to partner with you in taking care of your employees, we guarantee that you will feel listened to and taken care of throughout our relationship.

Did you know that payroll mistakes are their number one reason for leaving a job? While keeping up with payroll make seem like an easy task, changing laws and regulations, overtime, sick days, and benefits can severely complicate the process.

In the last five years, three out of five small businesses have been faced with lawsuits regarding the treatment of their employees.
We can make sure you keep track of overtime, holiday pay, sick days, and away leave.

We can help ensure that every hour, sick day, and comp day is accounted for so that you don’t lose money on labor.

We provide your employees with a simple statement each month outlining what they’re paying for healthcare, their remaining time off, and more. Don’t attempt to handle details like HSAs and 401Ks on your own. Let us take care of every aspect of your employee’s compensation.

We give you unlimited access to HR professionals.

At Idilus, we pride ourselves on having an experienced staff of human resources professionals at your disposal.

Before you start to read this article, we encourage you do some research on the startup lifestyle. It is a well agreed upon fact that starting, building, funding, and growing a startup or small business is intensely difficult. In fact, many sources suggest that at minimum, building a successful startup can require its people to work somewhere between seventy and one hundred hours a week for the first three to five years of a new company. If your startup is one of the few that has actually succeeded, you may find that you are still working around the clock to keep your vision alive. We list these facts and figures not to scare you or to deter you from chasing the entrepreneurial dream. We just want to ask one simple question: What if there were an easier way?

According to recent article on Forbes, writer Jeanne Pinder calls ‘the PEO option’ a “health insurance hack for entrepreneurs.” She goes on to make a case for how partnering with a professional employer organization (like Idilus) can allow entrepreneurs and small business owners to provide top of the line healthcare benefits to staff and prospective talent at a much lower rate. Intro our newest product, Simple Scale. Simple Scale is a top of the product specifically tailored to small-business owners, entrepreneurs, and startups. While Pinder is mostly focused on healthcare (it’s her field of expertise), we would like to steal her idea and call Simple Scale the ultimate business hack for entrepreneurs. Because, of course we can help you find top of the line insurance plans for your small company, but with Simple Scale your complete payroll compliance and human resources management are managed for you. Which on average has saved Simple Scale users close to 100 hours a month and 40% cost savings from what they paid in human resources management before Simple Scale.

Payroll Compliance is more complicated than you may think.

Everyday more rules and regulations are placed on employee payroll. For a small business owner who is spending most of their day keeping up with their product or service offerings, clients, customers, feedback, and general staff management- there isn’t much room to think about what it takes to get your people paid. Included in Simple Scale is a comprehensive payroll compliance package. This means that we will take care of making sure your people are paid on time, legally, and in the correct amounts. Most employees rank payment mistakes as the number one reason to leave a company. Enroll in Simple Scale and watch your retention increase.

Benefits Packages do not have to be tricky.

What are two of the biggest reasons that top talent decides not to leave a Fortune 500 company to join the corporate world? Compensation and job security. Startups are a historically risky field. Many job seekers feel unsure about their future in taking a startup job over a more secure established company job. Plus, usually startups cannot pay as much as other companies as they work on shoestring budgets and contend for funding. The benefit of using Simple Scale is that it can enable you to offer your existing and prospective staff better compensation monetarily and through benefits. Let us help you shop healthcare plans, 401Ks, and other options so that your employment offers carry the same weight as any other company’s. You will like the results.

Reduce risk, build culture, and make your people happy.

No matter what, at the end of the day, businesses are built and maintained by the people that build them. While that may seem like an obvious statement, one reason why people leave a job is because they don’t feel like the company they worked for cared about them. One component of Simple Scale is the option to let us help build your employee handbook, and lay an outline for the company culture you want to achieve and hire accordingly. We can help you present clear cut guidelines to your staff before they ever take the job with your company so that they feel protected and cared for from day one. We also have an entire team devoted to risk reduction and management. This can help keep you from incurring workers compensation claims, or help you mitigate them if you do. Keep your people safe, happy, and protected by signing up for Simple Scale.

Not matter what industry you are in, or what your startup is, we can help save you time and money through Simple Scale. Contact us today to
