<p>The court concluded that the FTC exceeded its authority when it issued the rule and was overly broad because it applied to <i>all </i>noncompete clauses rather than targeting harmful ones.</p>

										<content:encoded><![CDATA[<p>As reported in the IRS Newswire, Issue Number: IR-2024-203, the IRS <span style="box-sizing: border-box;">has been back to work on the Employee Retention Credit applications since</span> before September 2023, when the agency shut down processing to audit applications for fraudulent filing.</p>
<p>&nbsp;</p>
<p>&#8220;In recent weeks, the IRS has sent 28,000 disallowance letters to businesses whose claims showed a high risk of being incorrect. The IRS estimates that these disallowances will prevent up to $5 billion in improper payments. Thousands of audits are underway, and 460 criminal cases have been initiated. The IRS has also identified 50,000 valid ERC claims and is quickly moving them into the pipeline for payment processing in the coming weeks. <p>Several new and updated laws take effect in Cook County and Chicago on July 1, 2024. Keep reading for more details.</p>
<h1 id="LocalMinimumWageIncreases0" class="h1">Local Minimum Wage Increases</h1>
<h2 id="Chicago1" class="h2">Chicago</h2>
<p>For employers with four or more employees, the minimum hourly wage will increase to $16.20. The minimum hourly base wage for tipped employees will increase to $11.02—this is the first rate increase that’s part of the gradual phase out of the tip credit, which will be eliminated in 2028.</p>
<h2 id="CookCounty2" class="h2">Cook County</h2>
<p>The minimum hourly wage will increase to $14.05. The minimum hourly base wage for tipped employees will remain at $8.40.</p>
<h1 id="ChicagoFairWorkweekThresholdIncrease3" class="h1">Chicago Fair Workweek Threshold Increase</h1>
<p>The threshold for coverage under the Fair Workweek Ordinance will increase to $61,149.35 per year (if salaried) or $31.85 per hour (if paid hourly).</p>
<h1 id="ChicagoPaidLeaveandPaidSickandSafeLeave4" class="h1">Chicago Paid Leave and Paid Sick and Safe Leave</h1>
<p>Under the city’s new Paid Leave and Paid Sick and Safe Leave Ordinance, which applies to employers of all sizes, employees will be entitled to accrue two separate types of leave: Paid Leave (PL) that can be used for any reason and Paid Sick and Safe Leave (PSL) that can be used for the reasons allowed by Chicago’s previous paid sick leave law. Below are some highlights.</p>

The new rule, which takes effect on September 4, 2024, will void existing noncompete clauses, except for those with senior executives that were in effect before September 5, 2024. Employers must provide written notice to affected workers if they are subject to noncompete clauses that are no longer enforceable. <p>Effective July 1, 2024, the minimum salary required for the EAP (Executive, Administrative, Professional) exemptions from overtime will increase from $684 per week to $844 per week (equivalent to $43,888 per year). Also, the minimum total compensation requirement for the HCE exemption will increase to $132,964 per year, including at least $844 per week, which must be paid on a salary or fee basis.<br /><br />Employers continue to be permitted to use nondiscretionary bonuses, incentive payments, and commissions to satisfy up to 10 percent of the minimum salary requirement ($84.40 per week in the second half of 2024) for the administrative, professional, and executive exemptions, as long as these forms of compensation are paid at least annually.<br /><br />Currently, to fall within the executive, administrative, and professional (EAP) employee exemptions, an employee generally must:</p>



<ul class="wp-block-list">
<li>Be paid a salary, meaning that they are paid a predetermined and fixed amount that is not subject to reduction because of variations in the quality or quantity of work performed (the &#8220;salary basis test&#8221;);</li>



<li>Be paid at least a specified weekly salary level; and</li>



<li>Primarily perform executive, administrative or professional duties, as provided in the DOL&#8217;s regulations (the &#8220;duties test&#8221;).</li>
</ul>

<p>Highly compensated employees (HCEs) performing office or non-manual work and paid total annual compensation of a specified amount are exempt from the FLSA if they customarily and regularly perform at least one of the duties of an exempt executive, administrative or professional employee identified in the standard tests for exemption.</p>
<p>How does this impact you? Employers must review all employees paid on a salary basis to ensure they meet the salary requirements if they use the EAP salary exemption. If an employee does not meet the salary requirements, the employer can change the employee&#8217;s compensation to hourly or increase the salary to meet the salary requirements. Review the job duties tests referenced in the <a href="https://www.dol.gov/agencies/whd/fact-sheets/17a-overtime">DOL Fact Sheet</a> to determine whether or not an employee can be compensated hourly. 										<content:encoded><![CDATA[<p>The bottom line, it’s probably going to be a while before you see money.</p>
<p>The <a href="https://www.irs.gov/coronavirus/employee-retention-credit">Employee Retention Credit</a> offered is a tax credit provided to employers who had employees and were impacted by COVID-19.  Many employers are eligible for credit in one or several quarters.  This program hugely benefits several employers, especially small ones who suffered losses from the COVID-19 pandemic.</p>
<p>However, the IRS was behind in processing before firms began aggressively marketing offerings that they could help employers get this credit.  Let’s face facts – although COVID-19 shutdowns affected many businesses, they didn’t reduce revenue for every business.  Point in case – many companies that supported the need for people to shelter in place grew in 2020 and 2021.</p>
<p>As a result of the increased marketing to apply for the credits, many companies are receiving funds for while they did not qualify – and being required to return those funds.  For example, if an employer received a PPP loan during a specific quarter, they would not be eligible to use those wages for the ERTC for the same quarter.  The IRS offers <a href="https://www.irs.gov/coronavirus/frequently-asked-questions-about-the-employee-retention-credit">detailed information</a> on its website about this credit.</p>
<p>To complicate matters, when the employer is part of a PEO, it must submit the ERTC through the PEO’s consolidated tax filing.  As a result of some mechanical issues at the IRS, PEOs are required to submit amended 941s (941x) on paper by mail.  Yes, in 2023, the paper forms are being mailed to a post office box in Kansas City, MO, to be reviewed and processed accordingly.  Additionally, the IRS has had to staff up to address the growing demand for administrative processing.  As a result, many employees at the IRS are new hires.  Once the amended return is processed, the employer’s credit is given to the primary tax account of the PEO.</p>
<p>According to COO and CFO Jorge Solis of Idilus, “We have to track the process of all the 941x amendments manually, the date they were sent, received by the IRS, and when they have been forwarded for processing.”  Solis estimates it will take 2-3 weeks to receive notice that the IRS has received an amended return.  It has been, on average, taking 8 to 9 months to receive the credits from the IRS.</p>
<p>Effective Sept. 14, 2023, the IRS <a href="https://www.irs.gov/newsroom/to-protect-taxpayers-from-scams-irs-orders-immediate-stop-to-new-employee-retention-credit-processing-amid-surge-of-questionable-claims-concerns-from-tax-pros">placed a hold</a> on issuing ERT credits until 2024 due to credit abuse fraud from the pandemic relief program. For the IRS to strengthen claims processing, additional documentation may be required.</p>
<p>The IRS noted that hundreds of criminal fraud cases are being investigated, and thousands of claims are being audited.</p>
<p>On a more positive note, the IRS appears committed to correcting the situations of fraud and abuse that have plagued both this program and the PPP loan program to make sure the businesses legitimately in need of these funds receive them.</p>
